In premises liability cases, the plaintiff must demonstrate that the property owner was failed to maintain the property safe or failed to warn about known hazards. These can include situations such as slip-and-fall accidents, inadequate security leading to assaults, poorly maintained structures, or environmental hazards that the owner knew or should have reasonably known about.

The extent of the property owner’s duty changes depending on the legal status of the person entering the property. For instance, business owners owe customers the highest duty of care, while trespassers are generally the least.

Common premises liability claims include injuries from wet floors, icy walkways, poorly lit areas, falling objects, or dangerous animals. Damages in these cases may cover a wide range of costs, including medical expenses, lost wages, pain and suffering and punitive damages.

To defend against premises liability claims, property owners should conduct regular safety inspections, promptly address known hazards, and provide clear warnings for unavoidable dangers. Many property owners also carry comprehensive liability insurance for additional protection.
